Clearwater couple sued over alleged breach of contract

When two parties enter into a binding and lawful contract and one party fails to uphold their end of the bargain, the other party may have the ability to pursue a legal claim for damages. The complaint alleges that the couple served as predecessor-in-interest relating to a retail installment sale contract. According to Autovest Financial, the couple failed to make the payments they were responsible for in spite of numerous demands.

Because the couple has defaulted on their contract, Autovest is demanding payment of the amount owed in addition to unpaid interest in the lawsuit. The financial services company has also requested a trial by jury. However, in most breach of contract matters like this, the parties are able to reach an out-of-court settlement before the trial date arrives.
